The cop was not a witness to the action so the information he is getting is secondary and hearsay. You should request to be able to cross examine the primary witness–the camera. State that you’re willing to wait for the camera to show up in order to verbally testify, so that you may cross examine it. When they can’t produce a talking camera, motion to dismiss due to the witness failure to appear, and lack of supportive evidence. Request the camera be present at trial on your ticket response.

what i think should have happened was if the judge made a summary ruling like he did and wouldn’t listen then you should have asked for a change of venue because you felt like you were not getting a fair trial.2.ask for a trial by jury, if the state has to go through the expense just to prove their case then if its just traffic then it more than likely would have been dropped.

I had the same result when I challenge my local county court to provide the law that removes my right to give consent to a company to rob me of my money for ‘seewage undertakings’ – they do not have any right to remove consent from any contract – same thing here, no consent no contract no joinder…

Do I agree with the state’s tactics? No. But it’s a fucking traffic ticket, people. Ya know, there is defending freedoms and then there is just plain frivolty. I’ve gotten out of more traffic tickets simply by contesting and banking on the cop not showing up, which half the time they don’t and the other half if found guilty receiving the minimum fine by being respectful. This is just dumb.
