		<description>You can always negotiate with the other parent for the right to claim the child or a child.  Of course this is better to do prior to final divorce but the IRS doesn&#039;t care who claims as long as it is only one parent.

If no change in law from Congress, then a decision from the U.S. Tax Court in Washington, D.C. would be where you would file suit against the IRS.  You can also ask the IRS for a Private Letter Ruling on your personal situation and although not tax law can be used for your benefit and others also.  See more about private letter ruling at IRS.gov.  The IRS actually has a very good website.
